These conditions shall apply without prejudice to the application of the legal rules on the matter that may apply in each case. The General Terms and Conditions of Contracting regulate the distance selling relationship between BERLINAS MENORCA SL and the user or customer, in accordance with the legal provisions, especially Law 7/1998, of 13 April, on General Terms and Conditions of Contracting, Law 3/2014, of 27 March, which amends the consolidated text of the General Law for the Defence of Consumers and Users, the General Data Protection Regulation, Law 7/1996, of 15 January, on Retail Trade Regulation, and Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce. BERLINAS MENORCA SL reserves the right to make any modifications it deems appropriate, without prior notice, to the General Terms and Conditions. Such modifications may be made through its websites by any legally admissible means and shall be binding for as long as they remain published on the website and until they are validly replaced by subsequent ones. Nevertheless, BERLINAS MENORCA SL reserves the right to apply, in certain cases, Specific Contracting Conditions in preference to these General Terms and Conditions when it deems it appropriate, announcing them in due time and form. Information prior to booking: BERLINAS MENORCA SL informs that the booking procedure through its web pages is detailed in the corresponding section for formalising the booking. Likewise, BERLINAS MENORCA SL informs that the user may access the terms of use available on the same website. By booking with BERLINAS MENORCA SL through its website, the user or customer expressly declares that they know, understand and accept these terms of use and the General Terms and Conditions. Likewise, the user declares that they are of legal age and have the legal capacity and capacity to act necessary to access the websites of BERLINAS MENORCA SL and to contract through them. The user is responsible for treating confidentially and responsibly the identity and password obtained when registering as a customer, and may not transfer them to another person. However, BERLINAS MENORCA SL reserves the right to withdraw, replace or change the offers made available to its customers through its website simply by changing their content. Therefore, the products and/or services offered at any given time by the BERLINAS MENORCA SL website shall be governed by the General Terms and Conditions in force in each case. Likewise, the company shall have the power to stop offering access to the aforementioned products and/or services at any time and without prior notice. Price indication. Each possible booking offered shall indicate its price and whether VAT or any other applicable tax is included. The prices shown on screen shall be those in force at any given time, except in the case of typographical error. When the price is different for the reason stated above, BERLINAS MENORCA SL shall inform the customer by email before charging the booking. Availability. The availability of the offers provided by BERLINAS MENORCA SL through its website may vary depending on customer demand. Although BERLINAS MENORCA SL updates the database periodically, the booking requested by the customer may be fully booked at that time. In such case, BERLINAS MENORCA SL shall send the customer an email informing them of the impossibility of availability of the offer. Payment methods. BERLINAS MENORCA SL requests, for bookings through its website, the details of a credit card belonging to the booking holder in order to guarantee the effectiveness of the booking. We remind you that the establishment will charge your credit card when making this booking. The establishment reserves the right to check the validity of the credit card. If the corresponding invoice is required, please send an email to [info@menorca-transfers-services.com](mailto:info@menorca-transfers-services.com) Service conditions BERLINAS MENORCA SL offers the following types of transfer services in different vehicles, from a car (1-3 passengers), to a minivan (4-7 passengers) and up to a bus (8-60 passengers): a) Shared transfer (shuttle): The customer purchases one or more seats in a certain type of vehicle and, as a result, the transfer may be shared with other passengers. For this reason, the shuttle may make small diversions or stops to pick up or drop off passengers and the pick-up time, in this case, may be brought forward or delayed by a maximum of one hour from the time indicated in the booking, and the customer accepts these time changes. Time variations shall be communicated to the customer by telephone or email by the customer service department of BERLINAS MENORCA SL. The shared transfer (shuttle) will normally be carried out with a minibus or bus from 9 seats to 60 seats, although in some cases it may be carried out with a smaller vehicle. b) Private transfer: The customer purchases an exclusive transfer service for themselves and/or for a group of which they are part. The vehicle used is fully available to the customer for the booked service. The driver will take the customers from the departure point to the arrival point requested by the customer of BERLINAS MENORCA SL, which reserves the right to use the vehicle that is operationally available at that time to perform the contracted service. c) VIP transfer. The customer purchases a service carried out with luxury vehicles fully at their disposal from the departure point to the arrival point requested by the customer. Online bookings: a) When two or more people are included in the same booking, or when it is made by third parties, the person making the booking (Customer) shall be considered an agent with respect to the other members of the group (passengers) and therefore accepts the general terms and conditions of BERLINAS MENORCA SL on their behalf. b) From the moment of booking, the customer declares that they are of legal age and guarantees that all data provided are true, correct and complete, and that the credit or debit card used is owned by them and that there are sufficient funds to cover the cost of the service. BERLINAS MENORCA SL shall not be responsible for possible errors in the booking and no refunds shall be accepted in the event of a missed service as a result of such errors. If these errors mean that BERLINAS MENORCA SL or its suppliers must perform a service different from the one actually booked and, as a result, additional costs arise for the service, which shall be communicated to the customer through the BERLINAS MENORCA SL office, the customer must pay the difference directly to the driver before the service is performed. c) The customer should provide a valid mobile telephone number for one or more passengers, including the international code, in case any eventuality arises, since the departure time from resorts may vary in the event of bad weather, heavy traffic or any other reason that affects regular performance. If a customer does not have a mobile telephone number, they must indicate the telephone number of the resort where they will be staying. Any variation in pick-up shall be notified by telephone or SMS by BERLINAS MENORCA SL within the 24 hours preceding the transfer. The customer is asked to check any messages received on their mobile telephone from BERLINAS MENORCA SL. If the customer does not indicate any telephone contact in the booking, they must contact BERLINAS MENORCA SL to verify possible changes to the booking. In the event of changes to the timetable or other matters that cause the customer and/or passengers to miss the transfer, and they have not previously contacted BERLINAS MENORCA SL, the customer and/or passenger shall not receive any refund. Luggage a) Each passenger may carry one piece of luggage and one handbag. Each excess piece of luggage must be indicated in the “Special luggage” area when making the booking with BERLINAS MENORCA SL, which has the right to apply a possible supplement to the cost for excess luggage when this involves the use of a larger vehicle than is normally used for the number of passengers booked. b) If the customer carries a golf bag or bicycle for which a supplement may be indicated in the price, this must be indicated in the appropriate spaces during the booking. If this is not communicated in this way, BERLINAS MENORCA SL or its suppliers may refuse to transport the undeclared items. c) All luggage must be perfectly labelled with the owner’s name and destination address. Luggage shall be transported under the sole responsibility of the customer, who shall not be entitled to reimbursement for any possible loss or damage to such luggage. Luggage forgotten in the vehicle that performed the transfer service shall be taken to the address communicated by the customer, who shall bear the costs. d) BERLINAS MENORCA SL shall do everything possible to satisfy any special requests indicated in the appropriate spaces, but it is not obliged to do so. Delays a) BERLINAS MENORCA SL shall do everything within its power to reach the customer’s destination on time. Under no circumstances shall it be responsible for the consequences suffered by the customer as a result of the impossibility of making the transfer on time due to circumstances beyond the control of BERLINAS MENORCA SL and not directly related to the driver and/or force majeure, such as heavy traffic, extreme weather conditions, unforeseen diversions on the transfer route, accidents, police checks, safety stops made by the authorities, etc. b) If the service is not carried out or completed for a reason other than force majeure or a decision by the customer to waive the service, the customer may submit a documented and reasoned request for a refund of the amount paid for the service. Transport a) Smoking is not permitted in the vehicles. b) All BERLINAS MENORCA SL service providers reserve the right to refuse to transport any person who may be under the influence of alcohol or drugs and/or whose behaviour may be considered dangerous for the vehicle driver or other passengers. c) Passengers are not permitted to bring alcoholic beverages or narcotic substances into the vehicles for the purpose of consuming them there. d) All vehicles are covered by their owners with civil liability insurance in accordance with the laws in force in the country where the service is performed. e) All transfers carried out by BERLINAS MENORCA SL are door-to-door transfers. Cancellations, modifications and refunds Cancellations of bookings shall be made exclusively by email to BERLINAS MENORCA SL and shall be confirmed by BERLINAS MENORCA SL. If the customer does not receive an email confirming cancellation of the service, they must call the BERLINAS MENORCA SL offices. Cancellations of bookings must be made at least three days before the first transfer date. In this case, no penalty shall be applied and BERLINAS MENORCA SL shall refund the cost of the booked transfer and any applicable supplements; charges subject to payment for the credit card transaction or other means of payment are excluded from the refund. If the cancellation is made within three days before the first service date, the customer shall not be entitled to a refund. BERLINAS MENORCA SL has the right to cancel any booking at any time if it is unable to guarantee the transfer service correctly; in this case, the customer shall receive a refund of the price of the service as booked. Modifications made to already booked transfers and their applicable supplements must be sent to the email address: [info@menorca-transfer-services.com](mailto:info@menorca-transfer-services.com) at least 24 hours before the transfer. If the Customer does not receive an email acknowledging receipt of the modification, they must call the BERLINAS MENORCA SL offices. Withdrawal In accordance with Article 103 of Law 3/2014, of 27 March, which amends the consolidated text of the General Law for the Defence of Consumers and Users, the supply of services or goods made according to the consumer’s specifications or clearly personalised, or which, by their nature, cannot be returned or may deteriorate or expire quickly, are exempt from withdrawal. DATA PROTECTION In accordance with the provisions of current Personal Data Protection regulations, we inform you that your data will be incorporated into the processing system owned by BERLINAS MENORCA SL with CIF B57331993 and registered office at SANT CIRIL, 46 07702 MAÓ (ILLES BALEARS) SPAIN, for the purpose of facilitating, speeding up and fulfilling the commitments established between both parties. In compliance with current regulations, BERLINAS MENORCA SL informs that the data shall be kept for the period strictly necessary to comply with the aforementioned provisions. As long as you do not inform us otherwise, we will understand that your data have not been modified, that you undertake to notify us of any change and that we have your consent to use them for the aforementioned purposes. BERLINAS MENORCA SL informs that it will process the data in a lawful, fair, transparent, adequate, relevant, limited, accurate and updated manner. Therefore, BERLINAS MENORCA SL undertakes to adopt all reasonable measures so that they are erased or rectified without delay when they are inaccurate. APPLICABLE LEGISLATION AND JURISDICTION BERLINAS MENORCA SL also reserves the right to bring any civil or criminal actions it deems appropriate for the improper use of its website and contents or for breach of these conditions. The relationship between the user and the provider shall be governed by the regulations in force and applicable in Spanish territory. Should any dispute arise, the parties may submit their conflicts to arbitration or resort to ordinary jurisdiction in compliance with the rules on jurisdiction and competence in this regard.
